This Privacy Policy describes how Kiive Audio (the "Site", "Kiive", "we", "us") collects, uses, and discloses your Personal Information when you visit kiiveaudio.com, make a purchase, download a free plugin or trial, subscribe to our emails, or contact us for support.

Collecting Personal Information

When you visit the Site, we collect certain information about your device, your interaction with the Site, and information necessary to process your purchases and deliver your software. We may also collect additional information if you contact us for support or sign up for our emails. In this policy, "Personal Information" means any information about an identifiable individual.

Device information

  • Purpose of collection: to load the Site accurately for you and to perform analytics on Site usage so we can improve it.
  • Source of collection: collected automatically when you access the Site using cookies, log files, pixels, and similar technologies.
  • Disclosure for a business purpose: shared with our platform provider Shopify and with the analytics and advertising partners listed under Behavioral Advertising below.
  • Personal Information collected: version of web browser, IP address, time zone, cookie information, which pages and products you view, search terms, and how you interact with the Site.

Order and license information

  • Purpose of collection: to provide products to you and fulfill our contract, including processing your payment, delivering your download links and license keys by email and through your account, sending order confirmations and invoices, communicating with you about your order, and screening orders for potential risk or fraud. Where consistent with the preferences you have shared with us, we also use this information to tell you about our products and offers.
  • Source of collection: collected from you.
  • Disclosure for a business purpose: shared with our platform provider Shopify, the payment processor you choose at checkout (for example Shopify Payments or PayPal), the digital delivery and licensing application that issues your download links and license keys, applications that operate checkout and post-purchase offers on our store, our email service provider, and where applicable, product partners and licensors as described in the Product Partners section below.
  • Personal Information collected: name, billing address, email address, phone number if provided, payment information, and details of the products you purchased or downloaded.

Email marketing information

  • Purpose of collection: to deliver free plugins and trials you request and, where you have opted in, to send you product news, tips, tutorials, and offers.
  • Source of collection: collected from you at checkout, through forms on the Site, when you download a free plugin or start a trial, or through lead forms we run on platforms such as Facebook and Instagram.
  • Disclosure for a business purpose: processed by our email service provider, Klaviyo.
  • Personal Information collected: email address, name if provided, and how you engage with our emails.

You can unsubscribe at any time using the unsubscribe link in any of our emails, or choose which topics you hear about using the manage preferences link.

Product reviews

If you leave a product review, your submitted name and review content are processed and publicly displayed through our reviews provider, Judge.me.

Customer support information

  • Purpose of collection: to provide customer support.
  • Source of collection: collected from you.
  • Disclosure for a business purpose: processed through our business email provider (Google Workspace) and, where relevant to your order, Shopify.
  • Personal Information collected: email address, name, and any order or system details you share with us.

Sharing Personal Information

We share your Personal Information with service providers so we can run the store and fulfill our contracts with you, as described above. For example, we use Shopify to power our online store; you can read more about how Shopify uses your Personal Information at https://www.shopify.com/legal/privacy.

We may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant, or other lawful request for information we receive, or to otherwise protect our rights.

We do not sell your Personal Information.

Product Partners, Collaborators, and Licensors

Some of the products available on the Site are created together with, or licensed from, independent collaborators, artists, engineers, or partner brands. When you purchase one of these products, or when you opt in to receive a free product or promotional content connected to a specific partner, we may share limited contact information (such as your name and email address) with that product's creator or partner brand so that they may:

  • provide you with product updates, support, and related content, and
  • where you have opted in, send you information about similar products or offerings from that partner.

Information shared with a product partner is limited to customers who purchased or interacted with that partner's specific product, or who opted in through a partner-related promotion, and each partner is expected to handle your information in accordance with applicable privacy law.

Behavioral Advertising

We use your Personal Information to provide you with targeted advertisements and marketing communications we believe may be of interest to you. For example:

  • We use Google Analytics to help us understand how customers use the Site. You can read about how Google uses your Personal Information at https://www.google.com/intl/en/policies/privacy/ and opt out of Google Analytics at https://tools.google.com/dlpage/gaoptout.
  • We use the Meta pixel and Meta's Conversions API, connected through Shopify's Facebook & Instagram integration, to measure our advertising and reach audiences on Facebook and Instagram. This can include sharing information about your use of the Site, your purchases, and your interaction with our ads, in some cases as hashed identifiers.
  • We may sync hashed email lists to advertising platforms in order to include or exclude existing subscribers and customers from our advertising.

Using Personal Information

We use your Personal Information to provide our services to you, which includes offering products for sale, processing payments, delivering your software and license keys, providing support, and keeping you up to date on new products, tutorials, and offers. We send commercial electronic messages only where we have your consent or are otherwise permitted under Canada's Anti-Spam Legislation, and every marketing email we send includes a working unsubscribe.

Lawful basis (EEA and UK residents)

Pursuant to the General Data Protection Regulation ("GDPR"), if you are a resident of the European Economic Area or the United Kingdom, we process your Personal Information under the following lawful bases: your consent, the performance of the contract between you and the Site, compliance with our legal obligations, protection of your vital interests, performance of a task carried out in the public interest, and our legitimate interests where they do not override your fundamental rights and freedoms.

Retention

When you place an order through the Site, we retain your Personal Information for our records, including so we can verify license ownership and provide you with support, updates, and license resets over time, unless and until you ask us to erase it. Some records, such as tax and accounting records, must be retained for the periods required by law.

Automatic decision-making

We do not engage in fully automated decision-making that has a legal or otherwise significant effect using customer data. Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you, including temporary blocklists of IP addresses and payment cards associated with repeated failed transactions.

Your Rights

Canada (PIPEDA)

Kiive Audio is based in Ontario, Canada, and handles Personal Information in accordance with the Personal Information Protection and Electronic Documents Act ("PIPEDA") and applicable provincial law. You may request access to the Personal Information we hold about you, ask that it be corrected, or withdraw your consent to certain uses, such as marketing email. To make a request, contact support@kiiveaudio.com. If you are not satisfied with our response, you may contact the Office of the Privacy Commissioner of Canada at https://www.priv.gc.ca.

European Economic Area and United Kingdom (GDPR)

If you are a resident of the EEA or UK, you have the right to access the Personal Information we hold about you, to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased. To exercise these rights, contact support@kiiveaudio.com. Your Personal Information is initially processed in Ireland and is then transferred outside of Europe for storage and further processing, including to Canada and the United States. If you are not satisfied with our response to a complaint, you have the right to lodge a complaint with your local data protection authority.

California (CCPA/CPRA)

If you are a California resident, you have the right to know what Personal Information we hold about you, to request that it be corrected or deleted, to opt out of the sharing of Personal Information for cross-context behavioral advertising, and to not be discriminated against for exercising these rights. Cookies

A cookie is a small amount of information downloaded to your computer or device when you visit the Site. We use functional, performance, advertising, and analytics cookies. Cookies necessary for the store to function include those used for cart, checkout, customer login, and privacy settings (for example: cart, checkout_token, secure_customer_sig, _tracking_consent, _shopify_m). Reporting and analytics cookies include Shopify analytics cookies (for example: _shopify_s, _shopify_y, _landing_page, _orig_referrer) along with Google Analytics and Meta pixel cookies as described under Behavioral Advertising.

Session cookies last until you stop browsing, and persistent cookies last until they expire or are deleted, generally between 30 minutes and two years. Most browsers automatically accept cookies, but you can choose whether or not to accept them through your browser controls; see www.allaboutcookies.org for guidance. Blocking cookies may affect parts of the Site, such as accounts and checkout.

Do Not Track

Because there is no consistent industry understanding of how to respond to "Do Not Track" signals, we do not alter our data collection and usage practices when we detect such a signal from your browser.

Children

The Site and our products are not directed at children, and we do not knowingly collect Personal Information from anyone under the age of 13. If you believe a child has provided us with Personal Information, contact us and we will delete it.

Changes

We may update this Privacy Policy from time to time to reflect changes to our practices or for operational, legal, or regulatory reasons. The date of the most recent revision appears below.
